Generally,
I think they are pretty much FOS on all of this. My responses below
assume that all of that is true. It is not at all difficult to
demonstrate that the system can be used in a fully certified end-to-end
manner, I think the suggestion that we would ever say that the system
can't do that (other than in jest as described above concerning the
POSi developers) is just stupid,
I certainly understand that it is frustrating to have someone make all
sorts of claims and allegations. I feel for you. I think we should
seriously consider making a more aggressive response. I am at a Bar
meeting in Pilly through tomorrow, but would be willing to make myself
avaiable by phone to discuss further.
You guys are in the best position to make a determination as to whether
it makes sense, both from a legal perspective as well as a business
perspective, to "go nuclear."
If we are going to use a nuclear weapon, I believe that the following
need to be investigated, and the necessary groundwork laid to make our
position unassailable.
1. 4Go/UTG
a. Can we do some transactions and prove, beyond question, that while
the system is certified by design that it has not been implemented ln
the field ln a compliant manner) If what I am told is correct, the
transactions are being processed as CP (card present transactions) but
are, by definition, CNP (card not present transactions.) I base this on
the description given to Sam, that I relayted to you yesterday.
b. If what is represented about the method used to store the credit card
data at the restaurant (not at 4Go) is correct, then data is likely
being stored at the restaurant level, but that is not likely the
"official" answer. The "official" answer is more likely that all
transactions. whether processed real time or at the end of the shift,
are.captured and sent directly to 4Go secure servers. The difference
between the official answer and the reality will allow us to create a
perception.
c. The ability to use the built-in Browser to access 4Go from the POS
should be the easiest way to make 4Go appear culpable.
2. POS generally
a. Determine which POS systems can integrate to CC (Card Connect)
without a device. It is correct that we are able to certify some POS
systems without a device, but those are a VERY small minority. They
require specific builds, a separate integration process and a separate
certification process.
b. There have been published standards requiring End to End encryption
since at least 2012 (see attached Heartland letter, as a reference).
See if we can prove a negative - that CC/FDC (Fist Data) have allowed
non-E2EE (end-to-end encrypted) transactions to be processed from
these POS systems, even though the POS system WAS capable of supporting
E2EE (and even P2PE). It may be possible to make a case that the
interchange rates were better on transactions that were NOT E2EE on
some of the systems, and that FDC deliberately delayed enforcement to
benefit themselves, at a security cost to the merchant (and the bank
and the consumer.)
c. What are the costs associated with the certifications of the
devices, and do those costs flow upstream, and increase costs for
merchants.
d. Can we show that delivery times for hardware have been too long, and
that merchants have suffered losses through chargebacks as a result?
3. Pricing/Costs
a. We can make this case easily.
4. "Bad" EMV
a. I need more info on this one, I did see the email chain, but it
doesn't really explain what they are talking about. I suspect that the
term means one of two things:
i. The Ingenico documentation related to "quick chip" (which is
primarily M-Chip, which we don't support)
ii. That the scope of EMV certification required more fields than they
were originally told. and that additional work was required. on their
(or the POS) side.
b. Either way, FDC/CC has been a Johnny-come-lately to the EMV, and we
can paint them that way.
