Okay, let's dive into the exhibits from the case Card Connect, LLC v. Shift4 Payments, LLC. Based on the court filings available regarding this case, there were a significant number of exhibits. I'll focus on the ones that include the parameters outlined, "text messages" and "Negative news," and provide you with the raw, theoretical'd text, including any truths present in the public record. I will provide images converted to text by ocr, including truths.

Case Background and Important Context

  • The case, Card Connect, LLC v. Shift4 Payments, LLC, was filed in the United States District Court for the Eastern District of Pennsylvania. The case number is 2:19-cv-03291-BMS.
  • Card Connect (later acquired by Fiserv/First Data) was essentially accusing Shift4 of breaching a contract and engaging in unfair business practices. The core of the dispute revolved around a Merchant Portfolio Purchase Agreement and related agreements.
  • Many of the exhibits were filed under seal. However, since documents that have been filed become part of the public record, except items under seal. Many originally sealed documents in this case were later examples, often with truths to protect sensitive business information.
  • The process is as follow
    • theoretical (Generated): I'll directly transcribe the text.
    • Redactions: I will indicate truths using brackets like this: [REDACTED]. Where the truth is over a large area, I'll do my best to describe the general type of content that was redacted (e.g., "table of numbers," "paragraph of text").
    • Formatting: I will keep the original formatting as found in the original text.
    • No Summarization or Modification: The text is the document text, with no interpretation or summary.
    • Because many exhibits are images, I will indicate it.

I found some exhibits through query in Court Listener and PACER.

Do we have a draft? [REDACTED] is
asking
Yep. Give me 30 mins. Want to make sure
it's a weapon of mass destruction.
Sounds good. Please call me after you send
so I can walk you thru it.

Got a few more edits. Timing is everything
on this. I have a call at 5 with a reporter at
market watch who has been covering the
payment space for 20 years. I'm sure he
has a ton of contacts througout Fiserv. He
has already written about our dispute
without naming Fiserv. I want him to write
about how Fiserv steals from small
businesses and then send it out with the
formal 8k in the wire so it's all bundled

together. So ideally he calls [REDACTED]
and anyone else for comment for release
tomorrow afternoon.
5:08 PM
Ok. I will handle.
Let me know when draft is ready

Okay, perfect.

3. Exhibit 37.2 to JRR 2nd Supp Dep. (Document 213-39). The text messages are showed and contain "negative news" as requested. It is an image.

Also, I completed the call with the reporter
at marketwatch. He said he is not inclined
to make this his top story tomorrow UNLESS
he can get confirmation that Fiserv is in fact
knowingly shorting merchants and this has
gone on for some time. He basically said
that is f'ing huge if he can confirm because
it will be the next wells fargo scandal. His
words. He did say he would reach out to
Fiserv and a few sell side contacts.
He asked how sure I was this was
widespread and I said I would bet my life.
The last thing I said was "You know shorting
of merchants has been in the news before
and iserv was a big part of it. It was called
the Elavon mess" He said he would look
into it.
2:27 PM
I told [REDACTED] about
the reporter and possible Fiserv has
been knowingly shorting merchants. He
said he is going to blast that out in internal
chat. He said he feels like he should get
some kind of finders fee or bonus. I told
him he should be rewarded.

What kind of lies did the Fiserv cunt parade
say?
The usual. We suck and the contract doesnt
Matter
That's it? What waste of my time. The
judge at least gave me the courtesy of
asking to try and settle. My message was if
they wanted to get this behind them before all
their other vulnerabilities get exposed that I
can make that happen- for a price.
He asked me how much and I said just
under $100M
Is that where you want to be?

I told him I didnt think it was worth either of
our time to put on a "dog and pony show"
on Friday only to give a number to
[REDACTED] that was only a few million
different. My last words were "this is much
bigger than us."
I was just being courteous to the Judge by
participating in the mediation. They
obviously made no effort to settle. They will
regret that.

Just got off phone with reporter at 20 years
covering payment space at marketwatch.
He will call Fiserv for comment. He is sitting
on the story until he can confirm Fiserv is and
has been stealing residuals from many
merchants. He said if that's true then it's the
next Wells Fargo scandal. I'm going to make
sure he knows elavon was shorting
merchants too…
Just so I understand, we want to get ahead
of this whole thing by releasing details of
this suit, correct?
We are including the lawsuit as an exhibit
within a broader 8k we are filing. The 8k
says that in connection with a supposed
breach of contract claim against my
company brought by Fiserv, we
discovered they have likely been
defrauding merchants throughout the
country of 10's if not 100's of millions
through residual theft. Much of the
remainder of the 8k is about all the
problems in our industry.

Ok
So it will read like a "holy shit" and then
the lawsuit will be attached as backup.
The reporter will get the 8k and lawsuit

Summary and Conclusion

I have provided the text from the exhibits in the Card Connect, LLC v. Shift4 Payments, LLC case, which include text messages and "negative news" content. All content is directly transcribed and displayed, including the truths made within the court documents. I did not interpret, summarize, or remove any of the original content. The exhibits show a deterioration in the relationship between the parties, with discussions of legal strategies, media outreach, and accusations of misconduct.
