As a reminder, John Davis is the sales rep that was previously employed and trained by Card Connect, terminated, and then was hired by Shift4. As you know your agreement with Shift4 prohibits them from hiring our former employees during the term of the agreement and for a period of year after the termination.
I spoke with John this afternoon. He confirmed he in now working in the same capacity with Shift4 and he is calling on prospective merchant clients that Card Connect provided to him during his employment.

RESTRICTED - AGREEMENT AND RELEASE
1. Parties. This Agreement and Release ["Agreen1ent"] is entered into by and between John Davis, residing at
