Subject: Card Connect, LLC - Case 1:19-cv-01337-RGA

Hey guys,
Just wanted to provide a heads-up regarding the potential risk stemming from a lawsuit that we recently filed against CardConnect. As you know, this isn't a new dispute, but a continuation of the ongoing battle to secure our IP rights. By way of quick background, the two technologies at issue are: (1) our UTG, which we believe is being infringed by CardConnect's Bolt P2PE product; and (2) our tokenization technology, which we believe is being infringed by CardConnect's CardSecure solution.

We're not trying to win a popularity contest, but we will not bend on defending what's rightfully ours. We've made the following filings: 1) Original Complaint (D.I.
1); 2) Declaratory Judgment Counterclaims(D.I. 14); 3) Amended Complaint, which additionally alleges breach of contract (D.I. 33); and 4) Motion for PI (D.I.
35)."

Please note that this Motion for PI is critical to our overall legal strategy. The Motion seeks to enjoin CardConnect from continuing to solicit and market Bolt and CardSecure to new customers. As we've stated before, the ultimate goal of this lawsuit is to ensure that all of the Shift4 merchants utilizing CardConnect's alleged infringing products are returned to Shift4...or, at the very least, to ensure that CardConnect can no longer add additional revenue and/or profit until this dispute is resolved. We're also demanding royalties/damages for al/ of CardConnect's improperly diverted profits.

At present, this litigation is not widely known in the industry. However, we are anticipating some potential press when the Motion is heard, which may be sometime in January. All CardConnect solutions are the same and Bolt P2PE and CardSecure are simply names for their alleged infringing technology.
