I am the Chief Executive Officer of Shift4 Payments, LLC and Shift4 Payments,

LLC (collectively, Shift4). In this role, I oversee all of Shift4s operations.

On November 26, 2019, counsel for Card Connect notified Shift4 for the first time

of alleged infringement of the patents-in-suit on an investor call related to an unrelated matter. Before
this date, Shift4 was unaware of any allegations that its products or services infringed the patents-in-
suit, United States Patent Nos. 8,930,289 (the “‘289 Patent), 9,407,654 (the “‘654 Patent), and
10,135,811 (the “‘811 Patent) (collectively, the Patents-in-Suit). Indeed, before November 26,
2019, upon information and belief, Shift4 was unaware of the Patents-in-Suit.
