I, J. Gregory Richardson, declare as follows:
1. I have personal knowledge of the facts set forth herein.
2. I am the founder of Custom Business Solutions Inc, ("CBS"), a point of sale
dealer that sells plaintiff's products to merchants, who are its customers.
3. I am aware that in approximately May of 2016 an employee of Defendant
Shift4, Shani M Asher, sent a proposal to one of CBS's customer accounts.
4. This was not a customer account that CBS acquired through either legacy
First Data, or Card Connect.
5. Rather CBS acquired the customer, who had been an existing customer and
had an existing merchant agreement with Shift4 dating back to 2007.
