My client Mark Gallant has contacted me on two separate occasions now, complaining that he cannot set up any new locations with First American. I will walk through these one by one:

I will need assistance in understanding why we cannot board Mark's locations. He has a national presence and we will be facing this issue on his future locations. Mark has already spoken to an executive at First Data to ensure we are able to board his locations. He threatened to "take every merchant he has to FD" if they are not able to find a solution moving forward.

I don't have any specifics, but this stuff is going on all over the place. We just don't compete that well on the interchange cost, and it's pretty much impossible to find a situation in a processing statement where we can't save the customer significantmoney, especially when you get into the large merchant space. That's why the Card Connect sales team has been doing so exceptionally well. They have crushed us.
I can walk you through how the scam works next week. It's not that complicated.

I'm not sure I can get you exactly you what you are looking for in terms of a test on such short notice, but I am going to loop an expert on our team in this email to assist. I think he can walk you through how this scam works so you can put a stop to it.
Before he does, I think its important for you to know how massive this is, how much damage it is doing to your organization and ours and what a HUGE opportunity we have RIGHT NOW to fix it, while making a massive return for my company and yours.
Right now, your portfolio is losing a scary amount of customers. So is our portfolio of merchants that are using your processing services. Those customers are all calling us because we provide the software and gateway. When customers get their processing statements that are often $500 to $5000 more per month than what was agreed upon, they call us. We do our best to calm everyone down, but we don't have a solution. We have to protect the customer relationship and are forced too often to say, call First American. In many cases, you lose the customer. That doesn't help us. I attached a tiny sample of what my gateway support team is dealing with. I can send 100's more.
The "solution" here is simple. Give us the authority to reprice and rescue this business before it goes somewhere else. We give the customer a fair deal and agree to keep it that way forever. We save the customer. We both make a lot of money.

Regarding the Card Connect clawback:
• I don't see it that way. I don't believe large merchants generating 5 mil or more per year get boarding bonuses. So there is no risk to claw that back. Even if there was language that there could be claw back for that reason, it is not enforceable.
Regarding Payment Depot:
• I can match all Payment Depot pricing except for the $500k per month merchants. Payment Depot charges $ .25 per transaction for those accounts, I don't cover any costs for those merchants, no pci, no software, no equipment. Those $500k per month merchants would cost me more money.
What I can match is the pricing for merchants that are processing between $50k and $500k per month. For these merchants I charge the $79 fee, match interchange and provide free equipment, pci, software.
Regarding the 300-400 merchants processing millions of dollars per month that get sent to Payment Depot:
• We're not going to provide the capital necessary to convert these merchants back.
•
What I suggest is that FAP and Shift 4 start approving those types of merchants on the merchant agreement that I have provided.
Merchant's over 50k a month and less than SOOk per month, get the same structure as payment depot.
I have a boardable merchant right now for you, that is at $80k per month in processing volume. I am happy to set an example for you of how we can conduct business in a fashion similar to Payment Depot.
